Playing poker online in the United States and New York is NOT illegal. Simply put, you are not in violation of any laws when you play online poker as an individual.
There is however a large gray area in regard to online poker and the laws pertaining to it within the Empire state. Check your local jurisdictions.

- Tax on Players: 0-48.42%. You are taxed on your poker winnings at the Federal and State levels. Federal taxes can be up to 39.6% at the highest level. New York has a progressive income tax rate of 4% to 8.82%.
- Segregation: None – New York players share tables with players in other states and countries in the same combined player pool.

Live Poker in New York

There is currently no legislation within the state of New York in regard to online poker.
